Досліджується питання, пов'язане з корпоративними спорами. Визначається поняття корпоративного спору,

окреслюються його ознаки, а також підстави його виникнення. Також зазначається що в сучасних ринкових умовах економіка України все частіше потерпає від корпоративних спорів, що завдає шкоди не лише його учасникам, а й іміджу нашої держави загалом. Тому виникає необхідність вирішення корпоративних спорів з максимальною задоволеністю інтересів не лише одного учасника такого спору, а всіх його учасників. Сьогодні вфдомі не лише судовий спосіб захисту корпоративних спорів, а й позасудові способи захисту, які є більш прийнятними для застосування у розвинених державах світу. Зокрема, йдеться про медіацію. Так, використання медіації для вирішення корпоративного спору сприяє збереженню ділових та партнерських стосунків між учасниками спору, економії часу й фінансових ресурсів, а також задовольняє інтереси всіх учасників спору, а це, у свою чергу, сприяє розвитку бізнесу в державі, та розвитку й стабільності в економічній і соціальній сферах суспільного життя.

MEDIATION AS A WAY OF RESOLVING CORPORATE DISPUTES

In this article the author investigates the issue of corporate disputes. Also the author defines concept of corporate dispute, outlines its features, as well as the reason of its origin. The article also notes that in current market conditions the Ukrainian economy is increasingly suffering from corporate disputes. This situation affects not only participants of corporate disputes, but in general the image of our state. Today, there is not only a judicial way of protection of corporate disputes, but also extra-judicial way of protection which are more acceptable for use in developed countries of the world. In particular, we are talking about mediation. Thus, the use of mediation for resolve a corporate dispute contributes to maintaining business and partner relations between the parties of dispute, saves time and financial resources, and also satisfies the interests of all parties of the dispute. And this, in turn, contributes of development of business in the state, as well as development and stability in the economic and social areas of public life.
