Проведено дослідження практичних питань справедливого судочинства в контексті адаптації напрацювань Європейського суду з прав людини до української національної судової системи. Проаналізовано зміст понять "неупереджений", "безсторонній" суд, вивчено європейське розуміння принципу своєчасного доступу до суду як елемента права на справедливий суд. Наведено приклади хибного застосування цих основних принципів українським правосуддям.

Зазначено шляхи, які, на думку автора, сприятимуть поліпшенню ситуації в цій царині. Надано пропозиції щодо підвищення відповідальності суддів за порушення права особи на справедливий суд.

TIMELY AND IMPARTIAL CONSIDERATION OF THE CASE AS INTEGRAL ELEMENTS OF FAIR TRIAL: EUROPEAN EXPERIENCE AND UKRAINIAN PRACTICE.

This article is devoted to the study of practical issues of fair trial in the context of adapting the developments of the European Court of Human Rights to the Ukrainian national judicial system. The content of the terms "impartial" court is analyzed, the European understanding of the principle of timely access to the court as an element of the right to a fair court is studied. Examples of mistaken application of these basic principles by Ukrainian justice are given. The ways are indicated, which, in the opinion of the author, will help improve the situation in this area. Proposals are made to increase the responsibility of judges for violating the right of a person to a fair trial.
