Розкриваються поняття "родич" в адміністративно-деліктному праві. Досліджується процедура повідомлення родичів у разі застосування заходу забезпечення провадження у справі про адміністративне правопорушення у вигляді адміністративного затримання та мета такого повідомлення. На підставі аналізу чинного законодавства, теоретичних положень пропонуються зміни до Кодексу України про адміністративні правопорушення, які гарантуватимуть право на свободу та особисту недоторканність адміністративно затриманої особи, охорону прав, свобод та інтересів родичів, а також дотримання законодавства про захист персональних даних.

REPORTS OF RELATIVES IN THE EVENT OF APPLICATION OF A MEASURE TO ENSURE ADMINISTRATIVE PROCEEDINGS IN ADMINISTRATIVE OFFENSES IN THE FORM OF ADMINISTRATIVE DETENTION

The article reveals the concept of "relative" in administrative-tort law. The procedure for the reporting of relatives in the case of application of the procedure for ensuring administrative proceedings in an administrative offense in the form of administrative detention and the purpose of such notice is being investigated. Based on the analysis of the current legislation, the theoretical propositions are proposed amendments to the Code of Ukraine on Administrative Offenses, which guarantee the right to liberty and personal integrity of an administrative detainee, the protection of the rights, freedoms and interests of relatives, as well as compliance with the legislation on the protection of personal data.
